Volunteer Terms & Code of Conduct
Thank you for your interest in volunteering at Kite Festival Utah (the “Festival”), an event organized by Fundación Capitán Zarigüeya (the “Foundation”). By registering as a volunteer, you acknowledge that you have read, understood, and agree to the following Volunteer Terms & Code of Conduct.
1. Nature of Volunteering
- Volunteer participation is entirely voluntary.
- Volunteering does not create an employment, independent contractor, agency, or joint venture relationship with the Foundation or the Festival.
- Volunteers are not entitled to wages, benefits, or compensation of any kind, unless explicitly stated in writing.
2. Eligibility and Information Accuracy
By registering as a volunteer, you represent that:
- The information you provide is accurate, complete, and current.
- You meet the minimum age requirements established for the volunteer role, or you have obtained any required parental or legal guardian consent.
- You are physically and mentally able to perform the assigned volunteer tasks.
3. Volunteer Responsibilities
As a volunteer, you agree to:
- Act with respect, kindness, and professionalism toward all participants, including children, families, staff, vendors, and other volunteers.
- Follow all instructions, policies, and safety guidelines provided by Festival organizers and volunteer coordinators.
- Perform assigned duties responsibly and to the best of your ability.
- Immediately report unsafe conditions, incidents, or concerns to Festival staff.
- Help maintain a safe, inclusive, and welcoming environment.
4. Code of Conduct
The following behaviors are strictly prohibited while volunteering:
- Harassment, discrimination, abuse, or intimidation of any kind.
- Conduct that endangers yourself or others.
- Possession or use of illegal drugs, or being under the influence of alcohol or controlled substances during volunteer shifts.
- Any behavior that is inconsistent with the values and mission of the Foundation or the Festival.
The Foundation reserves the right to remove any volunteer from the Festival at its sole discretion for violations of this Code of Conduct.
5. Safety and Assumption of Risk
- The Festival will take reasonable steps to promote a safe environment; however, volunteering at an outdoor public event involves inherent risks, including but not limited to weather conditions, crowds, and physical activity.
- You voluntarily assume all reasonable risks associated with your participation.
- You agree to comply with all safety instructions and procedures.
6. Media Release and Use of Likeness
The Festival and Foundation may photograph, video record, or otherwise document the event for educational, promotional, and archival purposes.
By participating as a volunteer, you grant the Foundation a perpetual, royalty-free, worldwide license to use your name, image, voice, and likeness in any media, without compensation, for lawful purposes related to the Festival and the Foundation’s mission.
7. Liability Release and Indemnification
To the fullest extent permitted by Utah law:
- You release and hold harmless the Foundation, the Festival, their directors, officers, employees, agents, and affiliates from any claims, liabilities, damages, or expenses arising out of your volunteer participation, except where caused by gross negligence or willful misconduct.
- You agree to indemnify and defend the Foundation against claims resulting from your own actions or omissions during the Festival.
8. Changes, Cancellation, or Termination
- The Foundation reserves the right to modify volunteer roles, schedules, or assignments as needed.
- Volunteer participation may be terminated at any time for safety, operational, or conduct-related reasons.
- Volunteers may withdraw from participation at any time by notifying Festival organizers as early as possible.
9. Governing Law
These Volunteer Terms & Code of Conduct are governed by and construed in accordance with the laws of the State of Utah, without regard to conflict-of-law principles.
10. Acceptance of Terms
By submitting a volunteer registration form, you confirm that you have read, understood, and voluntarily agree to these Volunteer Terms & Code of Conduct.
